The off-payroll working rules have been designed to ensure those working like employees, but through their own company or LLP, pay roughly the same income tax and NICs as those who are employed.
These rules came into force on 6th April 2021, following a delay in 2020 due to the COVID-19 pandemic. This will place increased compliance pressure on clients who will now need to be actively involved in deciding who is inside and outside of IR35.
The rules around employment status haven’t changed, all that has changed is who needs to do the assessment and who ultimately will face the prospect of paying any unpaid employment taxes.
